Montana's Brian Schweitzer opens the door for rouge doctors

Doctors and hospitals will have more protection from medical malpractice lawsuits beginning July 1 under bills signed into law March 28 by Gov. Brian SchweitzerMontana: Gov. Brian Schweitzer R) last week signed into law four bills (HB 24), (HB 25), (HB 26) and (HB 64) addressing medical malpractice, the AP/Billings Gazette reports. The Montana Medical Association drafted three of the new laws and the other law was drafted by Montana hospitals. One measure states that physicians cannot be sued for apologizing or expressing sympathy, sorrow or condolence for the suffering or death of a patient, while another bill bars patients from bringing claims against doctors for medical mistakes made by someone that they were not directly supervising or working with, such as a pharmacist who dispenses the wrong medication. One of the bills establishes criteria for determining who can be qualified as an expert witness to testify about standards of medical care in a malpractice lawsuit, and another bill prohibits hospitals from being sued for the actions of independent contractors, such as doctors or other health care providers, who are not employed directly by the hospital. The state legislature is still considering five other malpractice-related bills (AP/Billings Gazette, 3/29).

Where's the gov at? I don't get it, is yellow stone centrally located or what? As a injured worker, (3 strokes, and boched by-pass, medical and meds denied and no comp) and with a case pending 4 years, What a nice perk for our state workers! No wonder they dont have time.

It appears that the number of deaths caused by Vioxx will be revised upwards to between 89,000 to 139,000 (the data is for the United States alone). Strokes and other vascular events not totaled at this date.

Montana state fund claims There is no medical evidence linking vioxx treatments to vascular events! 10-23-06 the state all ready sued Merck over price fixing and then we believe couldn't file suit on behalf of the states victims of Merck's vioxx do to the previous settlement. There does seem to be a case file, but the state is refusing to provide a summery.
This system is broke and i doubt there going to do any fixing in Yellow stone. Sadly i doubt that the people of this state will ever here about this perk the state fund employees are getting.
