To Whom It May Concern:

The records will show;
I suffered a back and shoulder injury in 1985, and still to this date experience lower back pain, nagging to sever at times.
Then diagnosed with carpal tunnel syndrome in 1989, witch over the next 10 years the Montana state work comp denied treatments for until 2000, at witch time I was treated with VIOXX, suffered 3 MI,s and then surgery on both arms.
In 2003 I was diagnosed with heart disease by William Hull and had a bye pass January 2004.
Shortly after my surgery I complained of various, pains and symptoms. Relapsed! graft failure.
I then filed a social security claim as well as brought to the Montana state funds attention of side effects do to the treatments with VIOXX, witch was found to be a DEADLY and TOXIC drug and removed from the market in late 2004.
While trying to prepare for a work comp trail, I found that Dr William Hull had falsified my medical notes. I filed a complaint with the state, witch they said it would be reviewed.
After subpoenaing all of my medical records from St Peters Hospital, I reviewed my x-rays, and found a ¾ inch metallic object in my chest cavity or heart.( X-RAY MOOO716787), when I wrote st Peters to ask a radiologist to review the film, they did not respond.
Knowing the way Dr Hull acted when he pulled out the ventricular lead and seeing it, I wrote ST Patrick’s hospital and asked for the manufactures name of the lead, I also subpoenaed Dr Hull, with no response to my question.
The Montana state fund was unable to get a cardiologist to see me, why? All IMEs that I have received from the state agencies and or the doctors I was referred to, have been incomplete and not appropriate for the conditions I have been treated for.
I once again asked st petes to review the x-ray, 2-10-10 this time I was at least emailed back and told that, yes there was hardware in my chest from surgery but that I would have to ask my doctor what it was. So who’s covering for who.
I then went to see Dr Mcree and ask to have yet another blood work up done, but of course she denied the request and said I had to make an appointment, (2weeks). She had also said previously that I was
” delusional about my health care” and suggested metal health. WELL MAYBE! So I went to butte, (a great clinic!) For blood work up orders, to included metals, (copper) once again I am suffering from an attack of gout plus all the other symptoms.
I have also researched copper poisoning.

Conclusion, ventricular wire broke off of the coil, that was placed in the chest and heart during bye pass surgery and removed in part by Hull. Dr Hull said in his notes “No problem removing that lead.”
For over 6 years, I may have been slowly poisoned and lied to by the so-called professionals and Montana state agencies. Just how deep are Merck’s pockets? or how far will doctors and state agencies go to protect there own in this state.


I don’t accuse or make complains lightly.

Dear Ms Hubbard

There sure seems to be a lot of mistakes, accidents and deception over the last 10 years.
So why didn’t or doesn’t the state once again investigate Dr William Hulls notes, my medical records, after I filed a complaint and my own investigation has uncovered wrong doing. If the review board would have properly reviewed all records the first time, they may have seen the possibility of part of a ventricular lead that had broke off and left in my chest or heart.
Also Ms Garcia of the Montana state fund testified at trail, (WCC NO. 2008-2092) that the Montana state fund paid for a COUPLE (2) of my prescriptions related to my heart conditions after my injuries received from treatments with VIOXX for my carpal tunnel in 1999- 2000. (Trail Exhibit notebook 3, file 83, pages 1-168), billing receipts received by the MSF (2000-2006) from Apollo enterprises and Working RX suggest differently. I request, that an audit been done, To see exactly what prescription were paid for on my behalf as well as the MSF and why was my medical information shared with out of state third parties with out my consent?
Ms Garcia also testified that she did not know why she was unable to schedule an IME with any cardiologist in the state and that all cardiologist declined. Some suggesting, “a conflict in interest with Dr Hull”. So why am I being discriminated against by the2/18/2010 state and health care officials in this state?.
The DPHHS has repeatedly denied social benefits, appropriate health care and medical evaluations since 2003. I have repeatedly stated that 5-6 months after my bye pass, one night I had relapsed, back to feeling worse than I was before. It’s a known fact that over 10% of bye passes fail with in the first year and Add the fact that I may have been subjected to copper poisoning.
The Health care officials, St Peters Hospital, St Patrick’s Hospital, Montana State and its agencies from the mediations at the Montana state department of labor, WCC, MSF, DPHHS to the city of Helena have repeatedly obstructed my right to health, health care and justice.
As a native Montanan born in Great Falls Montana, I believe that I have been denied my Constitutional rights as adopted by the constitutional convention on March 22, 1972, under Article II declaration of rights, Sections 3,4,9,10,16, Article XIII section 2 and as well as many other laws passed to protect the health and well being of humans of this state.

Had to visit your ER twice, do to pain from gout in the knee.
After talking with the Rocky Mountain Poison and Drug Center, http://www.rmpdc.org/ , about possible copper poisoning, they suggested that I report to the nearest hospital. So I talk with Denise, in Quality department and ask to have an x-ray looked at and told her that I have been possibly poisoned by a copper wire that had broke off from a ventricular lead removed by dr. William Hull of the International Heart Institute of Montana
She did follow up with this note
“I did talk to the director of our DI department who review your films and all we can say is yes you do have hardware in your chest from prior surgeries. You must review your films with your doctors. They are the ones who can tell you what should or shouldn't be there. I'm sorry I can be of more help.”
On 2-11-10 I came down with gout in the knee, on 2-16-10 I went in to the ER and told intake that I was suffering from gout and possibly was being poisoned by copper.
MD Heather Poag , ignored the copper issue and after 3 hrs ordered labs. I explained that I had come in on the 9th and had lab work up done. After another hour she had given me a scrip for 3 colchicine, nothing for pain. Then was kicked to the door, to walk ¼ mile to the pharmacy, then back to the parking lot, I stopped at records to get copy of blood work up from the 9th but it was still not available. I wish a pond DR HEATHER POAG, A Long labor with no meds!
2nd visit wasn’t much better; doctor would not listen to possible causes of symptoms being from copper poisoning. But did receive 9 col. and some hydro for pain.
I have been in and out of st petes dozens of times over the last 6 years, for symptoms after my bye pass and previous injuries, We all would benefit if the hospital would step up, quit covering up and get to bottom of a patients (my) symptoms. We don’t need health care officials covering up for the mistakes of others. Patient’s care and health must come first and the patient should not have to count on an attorney for health care.

Question, Will the state or St Peters try to corrupt my blood test resaults. We will see.

St Peters Hospital and Dr McRees cover up

On 2-8-10 i stopped at the cooperative health center,

Helena Montana and ask them to call the hospital and order a blood work up for me and to into metals (copper), then i went to the hospital St Peters and asked that my x-rays be re read, Dr MC Rees nurse never call,so i stop back and filled out the sliding scale forms, i was told that i would have to make an appointment in order to have them refer me for blood work up. and the soonest would be 2 weeks. after getting home the nurse call with the same info. then i got a email from st peters stating

Thank you for stopping in today with your concerns. I'm not sure how much help we can be. I did talk to the director of our DI department who review your films and all we can say is yes you do have hardware in your chest from prior surgeries. You must review your films with your doctors. They are the ones who can tell you what should or shouldn't be there . I'm sorry I can be of more help.

so the next day i went to BUTTE MONTANA, They have a great clinic. Was seen right away and written orders for blood work up, i was getting a flat so i had to take care of that first, and decided to have work up done in Helena, that could had been a big mistake. well we will see, if the lab gets in on the cover up. ShOULD have results by friday from salt lake.

Medicate, incarcerate and educated! And u ask what has happened to our state? The state is still denying benefits to Vioxx victims, while suing Merck and company in federal court for millions. MERCK spends over 1.5 million to buy your politicians.

State of Montana fights to with hold Viox information from the public, victims and the courts, stating subpoens requested were unduly burdensome!

Montana has been called by many nick names, one being the treasure state, now it is the west's newest Robin Hood, Sueing the Rich to give to there general fund! While dening the real victims any compensation or releif from witch the orignal law suit was filed.

Dear Sirs or Ms.
I am writing for two reasons.
Back in 2006, I sent a complaint to your office conserning Mercks Vioxx, and my damages And never received a response. I now find that the state may have a pending lawsuits against Merck & compamy.
I Am requesting a sumery of any current lawsuits that have been filed against Merck & company, envolving the drug Vioxx. under the
Constitution of Montana -- Article II -- DECLARATION OF RIGHTS
Section 9. Right to know. No person shall be deprived of the right to examine documents or to observe the deliberations of all public bodies or agencies of state government and its subdivisions, except in cases in which the demand of individual privacy clearly exceeds the merits of public disclosure.
Secondly Physician-Assisted Suicide Case
Rogue doctors in this state have been overdosing patients for years. While no one wants to see there love ones suffer, life should come first over the convenance of the doctor or hospital staff.
I have given this a lot of thought, and the involuntary euthanasia of my mother, 1-1-2005, died on 2-08-2005 was cruel and inhuman.
Coroner Mickey Nelson states the cause of death being, renal cell cancer. Fact I took my mother in to St Peters hospital do to her weakness and confusion. Dr Weiner had kept me in the dark from the very beginning and when I asked her primary phys (Cody Karen) for a second opinion, all I got is I am sure he is doing the best for her. I have not been able to locate a do not resuscitate order. Dr Weiner stated he wanted to do a brain scan to see if there was any signs of cancer, he did, there wasn’t. That was the last time I was able to speak to my mother, do to the constant overdose of meds. After reviewing the records, she received morphine, lorazepam and died of starvation and dehydration. If this state approves of Physician-Assisted euthanasia, it should only be carried out in the most humain matter and with only the permission of the patient and or family.

This morning I received a phone call from Lou Courts, apologizing for the delay and incomplete medical records that I had subpoenaed on 10-14-08.
While talking with her she suggested that I write you a note and explain my situation, to see if you could help and or shed any light on why I am being refused medical attention, from the Montana cardiologist community.
I am not sure where to start. First I would just like to say, I am not out to point fingers, just would like to have my health back and get the facts straight. On 1-8-04 I was admitted for a bye pass, referred by Dr Hull, of Helena at that time.
For the record, On 1-12-08 I left the hospital after receiving, a drug overdose, induced paranoid state, witch also made me sick to my stomach with dry hevs, that morning. I thought it best for me to get some fresh air at that time.
After seeing Dr. Hull in Helena, I started breaking out with sores on my back and having trouble swallowing. Then I came down with gout. A few more weeks went by and are started feeling very fatigued. He referred me to Dr Mulgrew for previous injuries I had. Dr Mulgrew had placed me on oxy. My last visit with Dr Hull, complaining of all of the above, and extreme fatigue, he stated not to come back until I stopped smoking a pack a day, witch was not true. At this time I was staying with my mother witch was ill. Missed diagnosed, and died of renal cancer, dehydration and starvation. 2-2005, and I started seeing a doctor at the county health clinic. I complained to Dr Mulgrew about the side effects of the oxy, (lack of concentration-fatigue) only to have my prescription increased. I have since quite taking it as of 3-1-08 and still have trouble concentrating, confusion and memory. During 2004 to the present I have had, well I will enclose some of the visits to Doctors and ERs. 6 months ago I woke up with my shoulders and neck sore and numb, and since an incomplete ime with Dr. Schumpert, soreness at the bottom of my rib cage on both sides. And have had abdominal pains and still having trouble swallowing, mostly after waking or resting in the morning.
In 2000 Dr. Todder treated me with vioxx for carpal tunnel. While taking it I had 3 strokes or Mis in 2001, then I brought that to the attention of the Montana state fund in 2005 they closed my claim, denying all medical. At my last mediation with the state fund, they agreed to pay for an IME. But now all cardiologist in the state have refused to see me. I was about to petition the court to send me to salt lake or where ever that will accept me, until speaking with Lou courts.
I also would like to know what make of bipolar ventricular lead wire was used during my by-pass, if you could find out for me that would be great. Notes do not state. When Dr Hull, pulled it out, I looked suspicious to me. No electrode on the end of the coil, and no bare wire. Plus after reviewing several x-rays, I see a small metallic object, (left side) that no one has ever explained. I am just so tired of feeling sick, after feeling so good right after my surgery.
I very much appreciate your time in reading my letter and if you can help me out great. As I said the state has agreed to pay for an IME, But have been refused by the cardiologist in the state, do to Dr Hull or my claim against merck. I hope I will find out what’s going on, no I will. I don’t think I necessarily need to see a cardiologist, just a little contrast and a ct scan of vascular system, mri brain scan, to show any damages from prior strokes. I started this letter a couple months ago. Just got back to it,

Montana state fund Conference 2-10-09

It was not right that I could not have a factual record of the proceedings of today’s (Conference)
It makes me sick to sit in the same room with someone that has repeatedly and mulishly, lied and assaulted me since 9-21-06.
I have furnished the state with pharmacy records showing that the state fund had paid for my meds from 7-11-00 to 9-21-06, until Ms Garcia closed my claim.
Also in your possession is Dr Maher’s notes (7-11-00) in witch he states “1. He is taking vioxx per Dr Toder for hand pain. 2. also we note that he has hypertension which probably need to be treated now” next note 8-31-01 states flu on carpal tunnel surgery. All so states “I think he should have a treadmill test” ??????????? Last surgery was in 12-00
Your request/demand today for an additional mediation is unjust and just another stall tactic. Fact 11-13-06 telephone mediation was held, were bi weekly benefits, vocational rehab, medical be restored, that included back, hand and cardio injuries was requested.
I don’t see the need to amend my original petition, as both claim numbers were included and all was addressed in the mediation of 11-13-06 with the states denials and lies.
Also I do not understand why the court is sharing my private information with a third party? (IOD incorporated)******** LETTER DATED 1-14-2009******* I Subpoenaed St Patrick’s Hospital for my records after several attempts in writing produced no results. To the best of my knowledge I never gave permission for st Patrick’s to share my records with IOD. Further more Ms Lou Courts of st patricks called me and stated that I did not have to pay for copies. A patient’s medical records should be private, and not be traded between corporations for profit or to extort money from the patients.

1) 1889 claim filed with Mt state fund, carpal tunnel claim ignored. And repeatedly denied.
2) 12-18-1997 state accepted liability, and agreed to pay for previous opinions/no treatments
3) 10-19-99 started seeing Dr Todder, started vioxx samples until state excepted claim.
4) 10-21-99 was required by the state to hire an attorney. (JOHN DOUBEK)
5) 4-03-00 visit and payment to Dr Todder
6) 6-15-00 retuned to Todder was given a prescription for vioxx due to claim being accepted by the work comp.
7) 7-11-00 saw Dr Maher, suggested to quit taking vioxx and should start something for HBP,
8) 8-6-00 traffic accident lost consciousness after visiting Dr Maher office, for loosing consensus twice the day before (STROKES)
9) 9-18-00 referred to Dr Pucket (for surgery on wrists and elbows)
10) 8-24-00 surgery
11) 9-13-00 asked Doubeck to stop taking 20% and take it out of final settlement. Couldn’t make mortgage payment. Biweekly payments based on work in 1989!
12) 9-28-00 fired Doubeck ,fax
13) 10-3-00 faxed Preszler to get by weekly started back. But said I had to have an attorney.
14) 10-9-00 was, forced to rehire doubek as state cut off biweekly benefits until represented by an attorney.
15) 12-05-00 surgery
16) 3-6-2001 IME, Dr Yorgason---incomplete/no medical notes were furnished by state fund.

28) Filled application with Montana legal services twice, both times denied help.
29) 8-6-06 sent another copy of records to WEITZ & LUXENBERG certified mail
30) Been sick ever since! 10/17/06 filed another claim with montana state fund.

32) Stopped oxy do to side effects and state denials. With holding meds, got tired of going threw with drawls ever other month, for 3-5 days at a time, over the last 4 years.

Montana's Brian Schweitzer opens the door for rouge doctors

Doctors and hospitals will have more protection from medical malpractice lawsuits beginning July 1 under bills signed into law March 28 by Gov. Brian SchweitzerMontana: Gov. Brian Schweitzer R) last week signed into law four bills (HB 24), (HB 25), (HB 26) and (HB 64) addressing medical malpractice, the AP/Billings Gazette reports. The Montana Medical Association drafted three of the new laws and the other law was drafted by Montana hospitals. One measure states that physicians cannot be sued for apologizing or expressing sympathy, sorrow or condolence for the suffering or death of a patient, while another bill bars patients from bringing claims against doctors for medical mistakes made by someone that they were not directly supervising or working with, such as a pharmacist who dispenses the wrong medication. One of the bills establishes criteria for determining who can be qualified as an expert witness to testify about standards of medical care in a malpractice lawsuit, and another bill prohibits hospitals from being sued for the actions of independent contractors, such as doctors or other health care providers, who are not employed directly by the hospital. The state legislature is still considering five other malpractice-related bills (AP/Billings Gazette, 3/29).

Where's the gov at? I don't get it, is yellow stone centrally located or what? As a injured worker, (3 strokes, and boched by-pass, medical and meds denied and no comp) and with a case pending 4 years, What a nice perk for our state workers! No wonder they dont have time.

It appears that the number of deaths caused by Vioxx will be revised upwards to between 89,000 to 139,000 (the data is for the United States alone). Strokes and other vascular events not totaled at this date.

Montana state fund claims There is no medical evidence linking vioxx treatments to vascular events! 10-23-06 the state all ready sued Merck over price fixing and then we believe couldn't file suit on behalf of the states victims of Merck's vioxx do to the previous settlement. There does seem to be a case file, but the state is refusing to provide a summery.
This system is broke and i doubt there going to do any fixing in Yellow stone. Sadly i doubt that the people of this state will ever here about this perk the state fund employees are getting.
